Article Two
THE EMPEROR
2.01
The Occidian Emperor is the Head of State and symbol of the State’s unity and sovereignty.
2.02
The Imperial Throne shall be succeeded by Imperial descendants, according to the provisions of the Imperial Household Law, following the principle of absolute primogeniture.
2.03
The Emperor is inviolable.
2.04
The competences of the Emperor are:
2.04.1
Exercise maximum authority in matters concerning the State;
2.04.2
Exercise the supreme command of the Imperial Forces of Defense, as Field Marshal;
2.04.3
Declare war and make peace, with the consent of the Council of Junkers;
2.04.4
Lead the country's foreign policy and represent it internationally;
2.04.5
Ratify international treaties and conventions;
2.04.6
Declare State of Exception;
2.04.7
Dissolve the Council of Junkers in cases of serious national security risk, as well as dissolve the legislature and convene it for the new legislative year;
2.04.8
Convene Sessions of the Council of Junkers;
2.04.9
Advise and be advised by the Council of Junkers;
2.04.10
Promulgate or veto laws passed by the Council of Junkers, except those amending the Constitution;
2.04.11
Propose bills to the Council of Junkers;
2.04.12
Exercise the right of clemency;
2.04.13
Moderate the actions of the Kings in the Empire.
2.05
The Emperor shall arbitrate and moderate the regular functioning of the Council of Junkers, and exercise the functions expressly conferred on them by the Constitution and the laws.
2.06
The Sovereign shall be addressed as the “His Imperial Majesty, the Occidian Emperor” or “Her Imperial Majesty, the Occidian Empress”.
2.07
The heir apparent of the Sovereign shall from their birth or from the time they acquire the claim, hold the title of “His Imperial Highness, the Occidian Crown Prince”, or “Her Imperial Highness, the Occidian Crown Princess”, and the other titles traditionally associated with the ruling house.
2.08
Should all the lines designated by law become extinct, the Council of Junkers shall provide for succession of the Imperial Throne in the manner most suitable to the interests of the Empire.
2.09
Abdications and renunciations and any doubt in fact or in law that may arise in connection with the succession to the Imperial Throne shall be settled by an organic act.
2.10
The Emperor, only possessor of Imperium, delegates the power to create and enforce laws to the Kings in the Empire.
2.11
The Emperor, as fons honorum of the Monarchy, may confer civil and military honors, decorations, medals and titles of nobility.
2.12
The consort of a Sovereign may not assume any constitutional functions, except in accordance with the provisions for a regency or the express consent of the Council of Junkers.
2.13
In the event a Monarch is under the age of majority, as determined by law, the Monarch’s parent or, in default thereof, the oldest relative of legal age who is nearest in succession to that
monarch’s respective Crown, according to the order established by law, shall immediately assume the office of Regent, which shall exercise during the Monarch’s minority.
2.13.01
If a Monarch becomes unfit for the exercise of their Imperium, and this incapacity is recognized by the Council of Junkers, the heir shall immediately assume the regency, if they themselves are of age. If they are not, the procedure outlined in the foregoing paragraph shall apply until the coming of age of the Heir.
2.13.02
If there is no person entitled to assume the regency, the Kings in the Empire must assume the Regency.
2.14
Any legal guardian of a Monarch during their minority shall be the person appointed in the will of the deceased Monarch, provided that he or she is of age and a citizen. If a guardian has not been appointed, the parent shall be guardian. However the offices of Regent and Guardian may not be held by the same person, except by the parent or direct ancestors of the deceased Monarch.

Exercise of the guardianship is also incompatible with the holding of any office or political representation.
