Article Three
THE KINGS IN THE EMPIRE
3.01
Imperium, as described and used in this Constitution, represents the executive and legislative powers and authority to create and enforce laws within the Occidian Empire vested on the Emperor, as bestowed upon by the people of the Empire in confidence.
3.02
Imperium shall be divested into two co-equal Crowns, the Kings in the Empire, who will serve concurrently as Heads of Government.
3.02.01
The monarchs of both Crowns shall be granted the title of “His Majesty, the King in the Empire” or “Her Majesty, the Queen in the Empire”, which shall be hereditary positions.
3.02.02
The King in the Empire shall possess the additional title and rank of “Sovereign” of a household.
3.02.03
Despite the variations in rank and title, both Kings in the Empire will be politically equal to the other and possess the right of veto upon the other.
3.03
The heir apparent of the King in the Empire shall from their birth or from the time they acquire the claim to his or her parent, hold a title traditionally associated with the noble house he or she belongs.
3.03.01
Should all the lines designated by law become extinct, the Council of Junkers shall provide for succession of the King in the Empire in the manner most suitable to the interests of the Empire.
3.03.02
Abdications and renunciations and any doubt in fact or in law that may arise in connection with the succession to the King in the Empire shall be settled by an organic act.
3.04
The Kings in the Empire shall, as stated previously, both possess the Imperium bestowed by the Emperor, the power to create and enforce laws, as a mandate.
3.04.01
When both monarchs are holding Imperium, all laws and actions must be supported and passed unanimously.
3.04.02
All laws and actions must be written down and made available for public record before they can go into effect.
3.05
Should a monarch find themselves by incident or obligation, unable to utilize their Imperium, they shall entrust their mandate of Imperium to their counterpart monarch.
3.06
A King in the Empire shall be allowed to request a review of their counterpart monarch before the Council of Junkers, to answer for their actions taken during the period of sole Imperium.
3.07
The Kings in the Empire of the Occidian Empire shall be safe from arrest or prosecution whilst they hold Imperium.
3.07.01
Should a King in the Empire be found to have violated the laws of the Occidian Empire or otherwise abused the powers of Imperium, as laid down in the Bill of Rights, their rights to Imperium will be entrusted to their counterpart until such a time as the Council of Junkers can convene a Trial of Impeachment.
3.07.02
Should a monarch be found guilty of a crime during a Trial of Impeachment, they may be fined, required to perform community service, or in the most severe cases, or upon request of the Emperor, forced to abdicate to their successor.
3.08
The Kings in the Empire shall possess the powers to:
3.08.01
Issue decrees approved by the Government, confer civil and military positions, and distinctions in conformity with the law.
3.08.02
Appoint and dismiss members of the Government.
3.08.03
Exercise the right of clemency in accordance with provincial law, which may not authorize general pardons.
3.08.04
Appoint Justices to the courts of the Confederation, with the approval of the Council of Junkers.
3.08.05
To lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defence and general welfare of the Occidian Empire.
3.08.06
To borrow money on the credit of the Occidian Empire.
3.08.07
To regulate commerce with other provinces and territories of the Grand Republic of Delvera.
3.08.08
To establish a uniform rule of naturalization, and uniform laws on the subject of bankruptcies throughout the Occidian Empire.
3.08.09
To promote the progress of science and arts, through both investment and by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries, but shall not extend beyond their lifetime.
3.08.10
To define and punish felonies and offenses against provincial law.
3.08.11
To raise and support an Imperial Forces of Defense, but no appropriation of money to that use shall be for a longer term than two years without voted extension by the Council of Junkers.
3.08.12
To make rules for the government and regulation of the Imperial Forces of Defense and provide for calling of forces necessary to execute the laws of the Confederation and Grand Republic of Delvera, suppress insurrections and repel invasions.
3.08.13
To approve laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the Government of the Occidian Empire, or in any department or officer thereof.
3.08.14
To issue Royal Charters, granting royal approval for businesses and organizations issued by such Charters, and allowing the Government a right to a share, to be determined by the Council of Junkers.
3.09
The privilege of the writ of habeas corpus shall not be suspended, unless when, in cases of rebellion or invasion, the public safety may require it and with the approval of the Council of Junkers.
3.10
No bill of attainder or ex post facto law shall be passed.
3.11
A regular statement and account of receipts and expenditures of all public money shall be published from time to time.
3.12
The consort of a King in the Empire, may not assume any constitutional functions, except in accordance with the provisions for a regency or the express consent of the Council of Junkers.
3.13
In the event a King in the Empire is under the age of majority, as determined by law, the Monarch’s parent or, in default thereof, the oldest relative of legal age who is nearest in succession to that monarch’s respective Crown, according to the order established by law, shall immediately assume the office of Regent, which shall exercise during the Monarch’s minority.
3.13.01
If a Monarch becomes unfit for the exercise of their Imperium, and this incapacity is recognized by the Council of Junkers, the heir shall immediately assume the regency, if they themselves are of age. If they are not, the procedure outlined in the foregoing paragraph shall apply until the coming of age of the Heir.
3.13.02
If there is no person entitled to assume the regency, the Emperor must assume the Regency.
3.14
Any legal guardian of a Monarch during their minority shall be the person appointed in the will of the deceased Monarch, provided that he or she is of age and a citizen. If a guardian has not been appointed, the parent shall be guardian. However the offices of Regent and Guardian may not be held by the same person, except by the parent or direct ancestors of the deceased Monarch.
3.14.01
Exercise of the guardianship is also incompatible with the holding of any office or political representation.
